PASS Summit 2009 “Friend Referral” Contest Rules

HOW TO ENTER
To enter the Friend Referral Contest (“Contest”), referrers must be currently registered for PASS Summit Unite 2009 or be registered by the Contest Deadline. The friends you refer must be new registrants to PASS Summit Unite 2009. Any applicable discount used in conjunction with this new registration cannot exceed $200 off the current and published Full Summit cost in order to be eligible for the Contest. Current registrations cannot be altered to take advantage of the Contest. The contest begins on September 30, 2009, and ends on November 1, 2009 (the “Contest Period”). All entries must be received by November 1, 2009, at 5:00 pm Pacific Time (“Contest Deadline”).
There is one (1) way to enter: When the friend you refer registers for PASS Summit Unite 2009 at http://www.regonline.com/Checkin.asp?EventId=685107, they must answer Yes to the following registration question: “Did you hear about PASS Summit 2009 through our Friend Referral program?” They will be prompted to enter the full name and email address of the registered attendee who referred them. Each person referred may only enter one name for the Friend Referral registration question. There are no limits to the amount of times a referrer’s name may be entered by different persons. All entries must be received by the Submission Deadline. Each new valid registration is equivalent to one entry.
Contest is open to legal residents of Canada and the U.S., except employees (and those with whom such employees are domiciled) or agents of the Sponsor. No employee, contractor, board member, or elected board member of PASS, the Professional Association for SQL Server, or its affiliated companies, his or her spouse, or immediate family members shall be eligible to win. Additionally, PASS reserves the right to disqualify any other person from participating in the Contest where such participation would, in the sole opinion of PASS, compromise or give the appearance of compromising the integrity of the Contest.
THE PRIZES AND APPROXIMATE RETAIL VALUES
There are several prizes to be won, as follows:
There are (3) Draw Prizes available to be won. Each Draw Prize consists of two (2) DELL Mini 10v Netbooks, one for the referrer and one for the person who was referred. Each referral registration consisting of a referrer and the person referred is considered as one entry eligible for a Draw Prize. The approximate retail value of each DELL Mini 10v Netbook is $350 USD.
There are approximately twenty (20) Second Prizes of one (1) DELL Mini 10v Netbook and one (1) PASS Summit 2010 Pre- or Post-Conference seminar for every person who refers three (3) or more valid new registrations to PASS Summit 2009. The persons who have been referred will only be eligible for the Draw Prize. The approximate combined retail value of each DELL Mini 10v Netbook and the Pre- or Post-Conference registration is $745 USD.
There is one (1) First Prize available to be won for the Top Referrer: One Full Summit registration to PASS Summit 2010. The approximate retail value of the Full Summit registration is $1,795 USD. Please note that the Top Referrer will also qualify for a Second Prize and will be eligible to participate in the Draw Prize.
Prizes must be accepted as awarded and are not convertible to cash. Prizes may not be transferred. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value. Any taxes on the prize are the sole responsibility of the winners.
A panel of judges appointed by the Sponsor consisting of members of the PASS Board of Directors and/or PASS Headquarters and/or its representatives will review all Contest entries and will participate in the draws.
The Contest drawing and review will be completed and the winners contacted by November 2, 2009. If you have not been contacted by this date, you may assume that your entry is not a winner.
The person with the most valid referrals (“Top Referrer”) will be entitled to a First Prize. In the event of a tie, all top referrers will be placed in a draw for the First Prize. Please note that the top referrer will also qualify for a Second Prize and will be eligible to participate in the Draw Prize.
All persons who refer 3 or more valid new registrations will be entitled to a Second Prize and will be eligible to participate in the Draw Prize.
All entrants (referrer and person referred) will be placed in a draw for the Draw Prizes.
Odds of referrer winning a prize increase with every referral made and are dependent on the number of entries. Odds of the person referred winning is dependent on the overall number of entries.
If PASS discovers the ineligibility of a winner as outlined in the official rules, the winner can be disqualified from winning any prize. PASS may select the next eligible person as the winner.
All winners must sign an affidavit of eligibility and release/waiver that releases PASS from any and all liability, claims, demands, or actions resulting from acceptance and use of the prizes awarded.
No correspondence will be entered into except with the selected winners. This contest is subject to all applicable federal, provincial, and municipal laws. Void where prohibited by law. The decisions of the contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal.
Selected winners will be required to sign and return a standard Declaration, Liability and Publicity Release, releasing the Sponsor, their respective advertising and promotional agencies, and the contest judges from any and all liability arising directly or indirectly from this contest, participation in contest-related activities, the awarding of a prize, and the use or misuse of any prize.
By entering the contest, selected winners agree to comply with these official contest rules and agree to the publication, reproduction, and/or other use of their name, address, company, voice, statements about the contest, and/or personal photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast, or the Internet.
The Sponsor, its advertising and promotion agencies, and the contest judges are not responsible for late, lost, misdirected, postage-due, delayed, or illegible entries. Without limitation, the Sponsor, its advertising and promotion agencies, and the contest judges will not be liable for the failure of any entry to be received.
The Sponsor reserves the right to withdraw or amend this contest in any way, in the event of an error, technical problem, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Sponsor reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.
Failure to sign the eligibility affidavit and release consent form will result in the forfeiture of prizes. All federal, state, and local laws, rules, and regulations apply.
Winners are responsible for all taxes incurred on all prizes awarded. Winners may be required to provide their tax ID number for tax purposes. All prizes are non-transferable and non-assignable. The decision of PASS with regard to all matters relating to the contest, including matters not specifically addressed in these rules, shall be final. A prize not claimed in accordance with these rules will be forfeited and not awarded. All unclaimed prizes become the sole property of PASS. Winners have (30) days from the day contacted to claim their prize.
